Property Law: Fair Housing

Property Law, geared towards an audience of first year law students

Zoning

When looking at housing issues, zoning issues can arise. These are typically local or state issues, not federal. Below are two goo Massachusetts sources, and one more general source on municipal law.

Secondary Sources

Fair Housing Act

The Fair Housing Act (FHA) was passed as part of the Civil Rights Act of 1968, P.L. 90-284. It is the basis for HUD's enforcement of anti-discrimination law in the area of housing.

Fair Housing Act Codification

Note that the FHA is not the only statute which impacts HUD. Title VI of the 1964 Civil Rights Act prohibits discrimination in any federally-assisted program.
